20, 2017, Secretary of Labor Puzder will be charged with reviewing a number of OSHA standards and directives that had been issued over the last eight years of the Obama Administration. According to Edwin Foulke, Jr., co-chair of the Fisher Phillips Workplace Safety and Catastrophe Management Practice Group and a former head of OSHA, these standards and regulations have been the subject of a number of criticisms from employers, many believing that they are overly broad and unduly burdensome. We anticipate that there will be a number of standards and regulations that will be reviewed within the first six months of the Trump administration, says Foulke. According to Foulke, there are quite a few that could be under Puzders microscope. First and foremost, the agencys Recordkeeping and Reporting of Occupational Injuries and Illnesses rule could be rolled back by Puzder. OSHA’s new recordkeeping standard was revised in 2016 and went into effect on Dec. 1. In those changes, OSHA required that employers provide a reasonable reporting policy for employees to report injuries and illnesses, as well as revising the recordkeeping retaliation provisions directly impacting safety incentives and drug testing. There has been a lot of concern raised by employers about these changes, says Foulke, which require employers covered by the standard to electronically file injury and illness information to the government.

Good question, say experts who help patients decipher and dispute their medical bills. After-hours surcharges, as theyre sometimes called, should be included in the regular fees charged by emergency physicians for an emergency department visit, they argue. But instead patients sometimes find an additional charge, generally between $30 and $200, tacked onto their bill for visiting overnight. Although not commonplace, the use of such surcharges may be on the rise. Weve definitely been seeing these surcharges a lot more this year than in the past, said Candice Butcher, vice president of Medical Billing Advocates of America in Roanoke, Va., which provides medical billingresolution services to individuals and companies. She pointed to a recent example last September in which an uninsured man visited a hospital overnight in Texas to have an abscess on his finger drained. The emergency physicians bill totaled $1,697: $910 forevaluation and management services, $749 for draining the abscess and $38 for original site receiving services between 10 p.m. and 8 a.m. In this case, as in others, the after-hours surcharge was a tiny fraction of the total bill. But it rankles people. People ask, Why are they charging me this extra fee for a facility thats open 24 hours a day? said Butcher.
